GENERAL TERMS AND CONDITIONS OF SALE OF SERVICES RELATING TO TUITION AND SUPERVISION OF SKIING AND OTHER SNOWSPORTS DISCIPLINES BY THE INSTRUCTORS AT EASY2RIDE IN MORZINE.
(SPECIAL COVID 19) If government regulations oblige the ski resorts to close and thus forcing us to close, all monies paid can be transferred to a credit note, or we can refund 90% of the monies paid.
By enrolling in Easy2Ride, Morzine, clients accept the General Terms and Conditions of Sale below:
I-Instructors
All Easy2Ride instructors are holders of a valid authorization to teach skiing and associated disciplines. Easy2Ride instructors all belong to the International Syndicate of Ski Instructors.
II-Insurance
Easy2Ride subscribes to a professional indemnity Policy which covers their instructors in the courses of their employment against any damage which they may cause to third parties as well as covering their clients whilst they are subject to the authority of Easy2Ride and the instructors.
The client and/or pupil is solely liable for their own equipment. The instructor cannot be held liable for any damage caused to the said equipment or for thefts or deterioration of the latter.
III-Choice of services provided
In order for lessons to run smoothly, it is important that pupils are of a similar level. It is impossible for Easy2Ride Instructors to check the level of each pupil prior to their enrolment. The pupil is therefore responsible for selecting their own technical level according to the level descriptions that are provided by Easy2Ride.
Easy2Ride and its instructors reserve the right to reorganize to ensure pupils are all a similar level, even if this means putting pupils into a higher or lower level. However, we cannot guarantee there will always be enough room in every class, and Easy2Ride will not refund or compensate clients should they have placed themselves in an inappropriate group.
Booking Deadline: Clients should try to reserve as early as possible to avoid disappointment. Reservations are only confirmed when they are paid for in their entirety and in advance. No contract exists until you have been issued with your sales receipt and booking number.
IV-How the services will operate
Learning to ski will take place in a specific but random environment. Accordingly, the client and/or pupil will be personally liable for his own safety and also for that of any third parties. The instructor’s liability will be limited to facilitating skiing lessons.
It is the responsibility of the client and/or pupil to follow the instructor’s instructions.
V-Prices
Easy2Ride’s prices are set out in the Easy2Ride brochure and also on the website. The prices quoted in the Easy2Ride brochure/website relate to tuition provided by an Easy2Ride Instructor. They do not include any other services (insurance, lift passes, equipment, etc…) unless otherwise stated.
Accordingly, prior to the lesson commencing, it is up to the client and/or the pupil, to obtain a pass in order to access the ski lifts and also to take out their own insurance which should cover them against any of the risks inherent in a sporting activity taking place in a mountain environment (public liability cover, emergency cover, etc…)
VI-Provisions as to registration and payment
To enroll, clients should send a booking form and total payment to Easy2Ride, either by credit card or bank transfer. The payment is evidence of the contract between two parties, and the dates are definitive.
VII – Cancellation of a booking by the client where full payment has been made:
In the event of you cancelling your reservation, the following charges apply:
More than 6 weeks notice 10% of fee
3-6 weeks notice 50% of fee
2-3 weeks notice 90% of fee
0-2 weeks notice 100% of fee
If you have taken out an insurance policy which covers cancellation please refer to the terms and conditions of that policy.
No refunds will be made by Easy2Ride, in part or in whole, for lessons not taken by the customer due to: delays, illness, accident, lifts closed due to bad weather, total closure of the domain or any other causes beyond the control of Easy2Ride, Morzine.
VIII – Cancellation / exclusion of client by Easy2Ride
8.1: Cancellation after the course has started:
Easy2Ride retains the right to cancel lessons before they are due to begin or after they have begun particularly in the event of force majeure.
Force majeure principally comprises of an event involving: closure of the ski slopes or of the ski lifts, weather conditions which are dangerous as regards the ski lessons accessing the practice area.
No refunds will be made by Easy2Ride, in part or in whole, for lessons not taken by the customer due to: delays, illness, accident, lifts closed due to bad weather, strikes, total closure of the domain or any other causes beyond the control of Easy2Ride, Morzine.
8.2: Exclusion:
Easy2Ride Morzine retains the right at any time to exclude any client whose behavior is such that it disrupts the proper delivery of the tuition. Should this occur, the client will not be able to claim any reimbursement.
8.3: Minimum Numbers:
Group lessons by definition require a minimum number of pupils to run. The minimum numbers are noted for each lesson type and level. In the event of insufficient pupil numbers, private lessons will be offered to the value paid for group lessons, or a refund will be offered. This will be a last minute decision. Easy2Ride reserves the right to cancel its lessons, or change lesson timings for various reasons. Full refunds of unused lessons will be made in this instance.
IX – Resolution of disputes
The parties shall endeavour to try their best to amicably resolve any problems which may occur during the currency of the contract. In the event that this is not possible, any disputes relating to either the validity, interpretation and/or execution of this contract will be exclusively governed by French Law.
All litigation of all kinds and inclusive of any summary proceedings will be subject to French civil and commercial jurisdiction.
